Terms of Service

You must be at least 18 years of age, or purchasing under the supervision of a parent or legal guardian, to place an order on the Site. By placing an order, you represent that you have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

All product descriptions, images, and specifications are provided for general reference only. We make reasonable efforts to display product colours and details accurately, but actual products may vary slightly due to photography, lighting, or display settings, and such minor variation shall not constitute a defect.

Prices listed on the Site are in Indian Rupees (INR) and are subject to change without prior notice. We reserve the right, at our sole discretion, to modify, discontinue, or limit the quantity of any product, and to correct any pricing or typographical error, even after an order has been placed and confirmed.

Placing an order constitutes an offer to purchase. An order confirmation email acknowledges receipt of your order but does not constitute acceptance. A contract of sale is formed only when we dispatch the product to you.

We reserve the right to refuse, cancel, or limit any order at our sole discretion, including in cases of suspected fraud, pricing or listing errors, unavailability of stock, or failure of payment verification. Where an order is cancelled after payment has been received, the full amount will be refunded to the original payment method within a reasonable time.

All payments are processed through third-party, PCI-DSS-compliant payment gateways. We do not store your card, UPI, or net-banking credentials on our servers. Your order will be dispatched only after payment has been successfully received and verified.

Estimated delivery timelines shown on the Site are approximate and not guaranteed. Delivery may be affected by courier delays, weather, regional restrictions, or other events outside our reasonable control, and we shall not be liable for any loss arising from such delays.

Risk in the product passes to you upon delivery to the shipping address provided at checkout. Please inspect your package upon receipt and report any visible damage as described in Section 6 below.

Because FreshNest is a food-contact storage product, for hygiene reasons we can only accept a return or replacement request within 7 days of delivery, and only where the product:

• arrived visibly damaged or broken in transit, or
• has a genuine manufacturing defect, or
• is materially different from what was ordered.

To help us process your claim quickly, we require an unboxing video or clear photographs showing the issue, submitted to hello@freshnest.in within the window above. Products that have been used, washed, or that are missing original packaging are not eligible for return, except where a defect is confirmed. Change-of-mind returns are not accepted.

Approved refunds are issued to the original payment method within a reasonable time after the returned product (where applicable) is received and inspected. Approved replacements are shipped subject to stock availability; where stock is unavailable, a refund will be issued instead.

Orders may be cancelled free of charge any time before they are dispatched, by writing to hello@freshnest.in. Once an order has been dispatched, it cannot be cancelled and is instead subject to the Returns, Replacement & Refunds policy above.

The Site and all content on it — including the FreshNest name, logo, product design, photographs, illustrations, and text — is owned by or licensed to us and is protected under applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written consent.

You agree not to use the Site to:

• violate any applicable law or regulation;
• attempt to gain unauthorised access to our systems, probe for vulnerabilities, or interfere with the Site's normal operation;
• submit false, fraudulent, or abusive orders or payment information; or
• scrape, reproduce, or resell Site content or product listings.

Marketing claims on the Site describe FreshNest as being designed to helpvegetables stay fresh for longer through ventilation and moisture management — this describes the product's design intent and is not a guarantee of a specific freshness duration, which varies with the type of vegetable, storage conditions, and usage. Except as expressly stated or as required under the Consumer Protection Act, 2019, the product is provided without warranties of any kind, express or implied.

To the maximum extent permitted by law, our aggregate liability arising out of or relating to any order shall not exceed the amount actually paid by you for that order. In no event shall we be liable for any indirect, incidental, special, or consequential damages, including loss of profits or loss of food/produce stored in the product.

You agree to indemnify and hold harmless FreshNest, its proprietor, employees, and affiliates from any claim, loss, or demand arising out of your misuse of the Site or breach of these Terms.

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, strikes, transportation disruptions, government restrictions, or courier/logistics failures.

These Terms are governed by the laws of India. Subject to Section 15 below, the courts at Haldwani, Uttarakhand shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

Any dispute, controversy, or claim arising out of or relating to these Terms, including any question regarding its existence, validity, or termination, that cannot be resolved through good-faith discussion within 30 days, shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by FreshNest. The seat and venue of arbitration shall be Haldwani, Uttarakhand, and the language of arbitration shall be English.

In accordance with the Information Technology Act, 2000, the rules made thereunder, and the Consumer Protection (E-Commerce) Rules, 2020, the details of our Grievance Officer are provided below. Complaints will be acknowledged within 48 hours and resolved within 30 days of receipt.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision shall not be deemed a waiver of that right. You may not assign these Terms without our prior written consent; we may assign these Terms freely in connection with a merger, acquisition, or sale of assets.

We may update these Terms from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. The “Effective date” above will be updated accordingly. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
